Ofcom illegal content Codes of Practice for user-to-user services implementing Online Safety Act 2023 including risk assessment provisions entered into force

On 17 March 2025, the Office of Communications (Ofcom)’s Codes of Practice on illegal content for user-to-user services under the Online Safety Act entered into force. Providers were required to conduct a risk assessment for illegal harms in compliance with the Act. Following the assessment, platforms must take appropriate measures to remove illegal content and reduce the risk of its reappearance. The Codes of Practice introduce accountability mechanisms, including the appointment of a senior person responsible for compliance with the codes for each type of illegal harm (such as terrorism or fraud). This person must report directly to the platform's most senior governance body. Platforms are also required to demonstrate an understanding of the risks posed by illegal harms to their users and how to mitigate these risks.
