Competition Authority of Kenya released Guide for Trade Associations

On 29 November 2016, the Competition Authority of Kenya released a guide for trade associations, developed pursuant to Section 9 of the Competition Act, aimed at promoting public knowledge and understanding of obligations, rights, and remedies under the Act. The guide outlines specific do’s and don’ts for associations to ensure compliance with competition law, including the establishment of effective compliance programs, careful handling of competitively sensitive information, and the avoidance of anti-competitive practices such as price-fixing, bid-rigging, and market allocation. It also emphasises the importance of transparent standard-setting, open consultations, and regular compliance reviews to foster a culture of competition within the economy.
