On 20 February 2025, the Act amending Kansas Statutes to regulate images generated by Artificial Intelligence (AI) in the context of child exploitation and breach of privacy was passed by the Kansas House of Representatives. The Act expands the definition of "visual depiction" to include artificially created or digitally altered images that appear to depict a child engaged in sexually explicit conduct. The Act addresses the unlawful transmission of a visual depiction of a child aged 12 to under 18 in a state of nudity. It includes both unlawful transmission and aggravated unlawful transmission, with the latter involving intent to harass, financial gain, or distribution to multiple recipients. The Act classifies a first-time offence as a Class A person misdemeanour, escalating to a severity level 10 felony for repeat offences. Aggravated cases start as severity level 9 felonies, increasing to severity level 7 for subsequent violations.
