Competition (Amendment) Act (No. 27 of 2019) including unilateral conduct regulation entered into force

On 31 December 2019, the Competition (Amendment) Act (No. 27 of 2019) entered into force. The Amendment Act introduces a new section specifically addressing the “Abuse of buyer power” (Section 24A). This addition expands the regulation of unilateral conduct by prohibiting the abuse of buyer power and outlining what constitutes such abuse. It also empowers the Competition Authority to monitor and enforce compliance in sectors where abuse of buyer power is likely.
