The Bill proposes to regulate the collection and use of location information by covered entities, allowing collection only when necessary to provide requested goods or services and when the individual has expressly opted in. It includes restrictions such as prohibiting the collection of more precise data than needed, limiting data retention, banning the sale or trade of location information, and preventing disclosures to third parties or government agencies without a valid court order. The Bill requires covered entities to provide clear notices when collecting location information and to maintain a detailed location privacy policy. It also prohibits state and local agencies from monetising location information and exempts healthcare data protected under existing health privacy laws. The Bill establishes potential liabilities for violations, including actual damages and civil penalties of up to USD 25'000 per offence, with enforcement powers granted to the Attorney General and local prosecutors.
