Bill on punishment of conspiracy against trade (SB 763) was introduced to Senate

On 21 February 2025, the Bill on the punishment of conspiracy against trade (SB 763) was introduced to the Senate of California. The Bill would amend the Business and Professions Code, known as the Cartwright Act, to increase criminal fines for corporate violators from USD 1 million to USD 100 million per violation and increase the maximum fine for individuals from USD 250'000 to USD 1 million. It also proposes to increase the maximum prison term for felony violations to 2, 3 or 5 years and to impose a civil penalty of up to USD 1 million per violation, based on factors such as the nature and duration of the misconduct. The Bill states that penalties collected would be allocated to the state or county treasury, depending on the prosecuting agency.
