On 20 February 2025, an Act Concerning Privacy, Online Surveillance, Social Media and Data Brokers (SB 1356) was introduced to the General Assembly. The Act would allow individuals to access, correct, delete, and obtain a portable copy of their information. Furthermore, it would grant consumers the right to opt out of targeted advertising, the sale of their data, and automated profiling that impacts significant life decisions such as employment and healthcare. The Act would impose obligations on data controllers and processors, mandating the limitation of data collection to essential purposes, the implementation of security measures, and the acquisition of explicit consent for the processing of sensitive information. Moreover, the Act would prohibit discrimination against individuals who exercise their data rights, and would require the provision of clear privacy notices that detail data collection and dissemination practices.
