On 10 February 2025, the Artificial Intelligence Amendments (HB 452) were introduced in the Utah House of Representatives, establishing provisions for the regulation of mental health chatbots that use artificial intelligence technology. The Bill introduces data usage regulations for mental health chatbots, prohibiting the sale or sharing of users' individually identifiable health information and chatbot input with third parties. Exceptions to this are permitted for entities that ensure the functionality of the chatbot, as well as for healthcare providers and health plans, provided that user consent has been obtained. The legislation also prohibits the use of chatbot interactions to personalise advertisements or determine whether to display specific ads. The Division of Consumer Protection is designated as the enforcement authority, with the power to impose fines and initiate legal action against any violations.
