On 10 February 2025, the Artificial Intelligence Amendments (HB 452) were introduced in the Utah House of Representatives, establishing provisions for the regulation of mental health chatbots that use artificial intelligence technology. It requires chatbots to disclose to users that they are AI-driven and not human, with disclosures required prior to access, at the beginning of interactions, and upon user request. The legislation prohibits AI chatbots from promoting specific products or services, unless they are transparently labelled as advertising with clear disclosure of sponsorship or business affiliation. In addition, providers must implement policies to ensure that chatbot development aligns with clinical best practices, involve licensed mental health professionals in review processes, and maintain protocols to monitor safety, address risks, and prevent harmful interactions.
