European Commission opened a consultation on revision of Technology Transfer Block Exemption Regulation

On 31 January 2025, the European Commission opened a consultation on revising the Technology Transfer Block Exemption Regulation (TTBER) and its accompanying Guidelines until 25 April 2025. With the present framework set to expire on 30 April 2026, the objective of the initiative is to update these instruments to provide clearer guidance for companies when concluding technology transfer agreements under Article 101 of the Treaty on the Functioning of the European Union. The objective is to ensure that only agreements which meet the necessary criteria are exempted from competition law, thereby safeguarding market integrity. The consultation seeks feedback on potential changes to address emerging issues such as data licensing, market share thresholds, and the evaluation of licensing negotiation groups.
