Council of State opened consultation on draft Platform Economy Act including unilateral conduct regulation

On 14 January 2025, the Council of State opened a consultation on the draft Platform Economy Act, including the regulation of user rights, until 14 February 2025. The Act includes competition-related provisions by imposing additional responsibilities on designated "gatekeepers". The Act designates "gatekeepers" as major platform service providers with significant market influence, defined by annual revenue exceeding THB 7 billion, at least 15 million monthly end users and 10,000 annual business users, and a sustained market position over three years. Once designated as a gatekeeper, the platforms must comply with 14 additional obligations, including non-discrimination against business users, contractual freedom for businesses to engage with end users, and advertising transparency through fee disclosures.
