The Japan Fair Trade Commission publishes its Guidelines Concerning Abuse of a Superior Bargaining Position in Transactions between Digital Platform Operators and Consumers that Provide Personal Information, which conclude that digital platforms are in a superior bargaining position when customers have no choice but to provide their data to use the services. The platform companies may abuse such a position when they do not sufficiently protect and disclose their use of personal data.
