Italian Competition Authority fines Amazon EUR 1.129 billion for market power abuse

On 9 December 2021, Italy's Competition Authority (Autorità Garante della Concorrenza e del Mercato) fined Amazon EUR 1.129 billion (case A528). In its investigation, the Competition Authority found that Amazon was abusing its market dominance and harmed rival operators. Amazon offers logistical services to firms that are selling products on its website, providing additional services such as warehouse space or delivery services. Italy's Competition Authority determined that third-party sellers that use Amazon's logistical services (FBA) have higher chances of being featured in the buy box than companies that don’t use FBA. The agency noted that Amazon was discriminating against third parties that were not using its logistic services to increase its profits, as it receives a higher percentage per product.
