Consultation opened on draft guidelines on application of EU competition law to collective agreements

On 9 December 2021, the EU Commission published and opened a consultation on its draft guidelines on the application of EU competition law to collective agreements regarding the working conditions of solo self-employed person. The guidelines seek to clarify when the prohibition on undertakings restricting competition within the internal market (Art.101 TFEU) will not apply to collective agreements made by solo self-employed persons. Specifically, this situation would often apply to those performing work for online platforms as self-employed people. The consultation will close on 24 February 2022.
