On 3 December 2024, the Office of the Data Protection Commissioner (ODPC) opened a public consultation on the draft Data Sharing Code until 6 January 2025. The draft code provides a framework for responsible and ethical data sharing practices within both the private and public sectors. It addresses principles such as lawfulness, fairness, transparency, and data minimisation while outlining the legal basis and scope for data sharing. The draft code details the responsibilities of entities involved in data transfer, emphasising the need for data-sharing agreements, safeguards, and data protection policies. It also covers specific scenarios like emergency data sharing, cross-border data transfers, and the importance of conducting benefit-risk assessments. Enforcement measures are outlined to ensure compliance with the Data Protection Act, 2019, and related regulations, aiming to protect individuals' privacy rights and promote secure, accountable data sharing practices.
