Executive Decree No. 22-39 on setting the conditions for issuing the general authorisation for electronic communications services entered into force

On 15 July 2022, Executive Decree No. 22-39, outlining the conditions for issuing general authorisations for the establishment, operation and provision of public electronic communication services entered into force. Enforced by the Regulatory Authority for Post and Electronic Communications, the decree applies to any individual or legal entity formed as an Algerian company, provided they meet the specified technical and financial capacity requirements and service-specific terms. The authorisation is valid for seven years and renewable for similar periods. It is non-transferable and requires regulatory approval for significant changes in shareholding. Applicants must submit detailed project descriptions, financial statements and other relevant documents. Financial obligations include an initial fee of DZD 100'000, varying annual royalties based on the service type and a 0.5% annual contribution to training, research and standardisation. Existing authorisation holders must comply with the new decree within six months of its publication, which also abrogates any conflicting previous provisions.
