Ghana: Adopted Cybersecurity Act 2020 (Act 1038) including operational license requirement

On 6 November 2020, the Cybersecurity Act 2020 (Act 1038) was adopted by the Parliament of the Republic of Ghana. The Act outlines the licensing requirements for cybersecurity service providers. According to the Act, entities must obtain a license from the Authority to provide cybersecurity services. Failure to do so results in an administrative penalty. The application process involves submitting a written application with supporting documentation and a prescribed fee. The Authority can suspend or revoke a license for various reasons, including non-compliance with conditions, fraud, or if it is deemed not in the public interest.
