On 2 December 2024, the Utah Office of Artificial Intelligence (OAIP) signed a regulatory mitigation agreement with ElizaChat, a developer of an app aimed at improving teenage students' mental wellness through AI. This agreement outlines ElizaChat's commitment to adhering to data privacy standards, promoting positive mental health practices, and ensuring adult supervision in sensitive situations. It mandates ElizaChat to establish a robust internal safety protocol for escalating severe cases to trusted adults and provides a 30-day rectification period for instances where the app may inadvertently engage in conversations requiring state licensure for mental health therapy. Regulatory mitigation agreements are tools which can be use to establish case-based limited exemptions from certain regulatory requirements.
