On 6 December 2024, the Secretariat of Government and Digital Transformation (SGTD) closes the consultation on the new draft of the Regulation of Law no. 31814 promoting the use of artificial intelligence (AI) for the economic and social development of the country. The new draft Regulation reaffirms prior requirements. It would mandate AI providers to identify and assess risks associated with their intended purposes and foreseeable misuse and implement suitable risk management measures validated by independent third parties. Additionally, it would require the incorporation of adequate design practices, data treatment, and validation processes to ensure the relevance, representativeness, and completeness of the data used while also addressing biases and deficiencies. Furthermore, the draft Regulation includes measures regarding the traceability of AI systems' operation, automatic recording of system use details, and the preparation of detailed validation reports to facilitate verification and auditing. Human oversight is also mandated, ensuring the presence of interfaces allowing human intervention in AI decision-making processes, alongside the implementation of security measures to resist errors, inconsistent results, and unauthorised use attempts.
