Issued order in FTC investigation into AliExpress and Temu over alleged unfair terms and conditions

On 20 November 2024, the Korean Fair Trade Commission (FTC) issued an order pertaining to 47 unfair terms and conditions across the platforms AliExpress and Temu. FTC highlighted that the platforms included provisions that unfairly exclude platform operators' liability, permit excessive collection and misuse of personal information, and designate foreign courts as exclusive jurisdictions for disputes. FTC highlighted particular unfair provisions including disclaimers of legal liability, limits on compensation, vague clauses on account termination, and prohibitions on litigation. Following the FTC's intervention, AliExpress and Temu revised their terms to ensure compliance with local consumer protection laws.
