On 25 December 2024, Decree 147/2024/ND-CP on the management, provision and use of internet services and online information adopted by the Vietnamese government enters into force. The Decree applies to domestic and foreign organisations and individuals directly engaged in or related to the management, provision and use of internet services, online information, and online games, and ensuring information safety and security. The Decree establishes separate regimes for offshore and onshore social network services in Vietnam. Offshore providers with 100’000 visits per month for six months must notify the Authority of Broadcasting and Electronic Information. Onshore providers with 10’000 visits or 1’000 regular users per month must obtain a Social Network License, while those with lower traffic need a Notification Certificate. The Decree also regulates livestream activities, setting eligibility conditions for providers and accounts. Foreign entities can only offer online games in Vietnam by establishing a local enterprise, with cross-border gaming services remaining prohibited.
