Issued preliminary ruling from Supreme Court on direct action of unconstitutionality filed by the National Confederation of Commerce against Fixed Odds Betting Law (No. 14,790/2023)

On 12 November 2024, the Supreme Federal Court (STF) issued a preliminary decision accepting a legal challenge filed by the National Confederation of Commerce (CNC) against Law No. 14,790/2023, which regulates fixed-odds betting in Brazil. This law, enacted on 30 December 2023, introduced a regulatory framework for fixed-odds betting, covering licensing, advertising, taxation, corporate and regulatory requirements, and social considerations. The STF accepted a legal challenge to the law from CNC, determining that, pending a final ruling, advertising for fixed-odds betting services targeting children and adolescents is prohibited and enforceable immediately.
