On 5 December 2024, Brazil's National Data Protection Authority (ANPD) closes the public consultation on the artificial intelligence (AI) and data protection regulatory project. The General Personal Data Protection Law (LGPD) mandates the review of decisions based solely on automated data processing that affect personal interests, ensuring transparency and the right to appeal such decisions. It also requires controllers to provide clear information about the criteria used for automated decisions. The consultation aims to identify practices aligned with LGPD principles and guidelines, focusing on AI's impact on privacy, data protection, and rights such as erasure and consent revocation. The consultation includes 15 technical questions across four areas, LGPD principles, legal assumptions, data subjects’ rights, and good practices and governance.
