Announced UOKiK public lawsuit against Temu for allegedly not providing clear information about the seller

On 16 October 2024, the Polish Office of Competition and Consumer Protection (UOKiK) announced that it had brought charges against Temu for not providing clear information about the seller and for issues such as the labelling of payment buttons. In particular, UOKiK states that the company responsible for sales in Poland is Whaleco Technology Limited, an Irish company based in Dublin. However, when shopping on Temu, consumers often do not have transparent information about whether they are concluding a contract with an individual seller or a company, and the division of responsibilities between Temu and the seller is unclear. The UOKiK raised concerns about the lack of transparency in seller identification and in the way key information, including complaints, returns, and contract rescission, is presented. If the charges are proven, Whaleco Technology Limited could face fines of up to 10% of its turnover.
