South Africa: Adopted data and cloud policy including competition policy review

On 31 May 2024, the Department of Communications and Digital Technologies adopted the data and cloud policy including competition policy review. The policy recommends that the Competition Commission review the Competition Act regarding the data and cloud markets, based on empirical evidence, and may enhance the law to address competition issues. The policy also encourages the Commission to conduct studies in the data centre and cloud services sectors to identify anti-competitive trends and suggest potential preventative measures.
