Introduced Broadcasting Services Amendment (Prohibition of Gambling Advertisements) Bill 2024

On 19 August 2024, the Broadcasting Services Amendment (Prohibition of Gambling Advertisements) Bill 2024 was introduced at the House of Representatives. The Bill seeks to amend the Broadcasting Services Act 1992 to prohibit gambling advertisements on various broadcasting and online content services in Australia. In particular, the Bill introduces amendments, prohibiting commercial television, radio, and subscription services from broadcasting gambling advertisements, except in cases of incidental or accidental broadcasts. Furthermore, the Bill extends the prohibition to certain online content services, particularly those related to sporting events and on-demand programs. In addition, the Bill replaces existing definitions with different standards, defining a gambling advertisement as any visual or audible message promoting gambling services or related content. Incidental broadcasts are exempt if no financial benefit is received. Civil penalties will apply for non-compliance, and the Australian Communications and Media Authority (ACMA) will enforce the rules.
