European Union: Filed request to CJEU for a preliminary ruling in a lawsuit regarding GDPR violations on customer data consent (Koninklijke Nederlandse Lawn Tennisbond v Autoriteit Persoonsgegevens) (C-621/22)

Description

Filed request to CJEU for a preliminary ruling in a lawsuit regarding GDPR violations on customer data consent (Koninklijke Nederlandse Lawn Tennisbond v Autoriteit Persoonsgegevens) (C-621/22)

On 29 September 2022, the Rechtbank Amsterdam submitted a request for a preliminary ruling regarding a dispute between the Koninklijke Nederlandse Lawn Tennisbond (KNLTB) and the Autoriteit Persoonsgegevens (AP). The case involves the interpretation of the term "legitimate interest" in the context of data protection law. The court seeks clarification on three key questions. Firstly, the CJEU is asked for clarifications on the term legitimate interest and how it should be interpreted by the District Court. Secondly, the CJEU is asked if the term legitimate interest should be interpreted as the respondent does and if the interests exclusively pertain to the law, constitute law, or are enshrined in a law. Third and lastly, the CJEU is asked if any interest can be a legitimate interest, provided that interest is not in breach of the law. This includes a purely commercial interest.
