Filed public lawsuit against TikTok for sharing minors’ personal data without parental consent

On 3 October 2024, the Attorney General of Texas (AG) initiated legal proceedings against TikTok in a public lawsuit. The lawsuit alleges that TikTok has violated the Securing Children Online through Parental Empowerment (SCOPE) Act. In accordance with the provisions of the SCOPE Act, social media platforms such as TikTok are precluded from disseminating, disclosing, or selling a minor's personal information without the express consent of the minor's parent or legal guardian, as well as requiring companies to provide tools for parents to manage children's privacy advice. The lawsuit alleges that TikTok has failed to comply with these obligations. The AG is seeking civil penalties of up to USD 10'000 per violation, in addition to injunctive relief to prevent future violations.
