Opened consultation on Draft ETDA Notification regarding AI Risk Assessment

On 17 July 2023, the Electronic Transactions Development Agency (ETDA) published the draft Notification regarding AI Risk Assessment and opened a public consultation until 19 August 2023. The draft regulation would establish standardised guidelines for assessing and managing risks associated with Artificial Intelligence (AI) systems in Thailand. The proposed framework covers four main components: governance, risk mapping, risk measurement, and risk management. Governance involves implementing systematic management mechanisms and fostering a risk-aware culture within organizations. Risk mapping focuses on understanding scenarios, data, and environments to create a comprehensive risk profile. Risk measurement sets indicators for evaluating and measuring risk levels. Finally, risk management entails prioritising and mitigating identified risks based on their severity. Under the regulation, AI importers and service providers must create detailed risk assessment reports using either a use-case approach or a cross-sectoral profile. These reports should identify potential risks and document management measures according to the ETDA’s checklist. The ETDA will review and update these criteria periodically to reflect technological advancements and evolving contexts, ensuring the framework remains effective. Stakeholders impacted by this regulation include AI developers, digital service providers, government agencies, and the general public.
