Thailand: Implemented ETC order on rules, procedures and period for notifying the change of terms and conditions of digital platform services (2566)

Description

Implemented ETC order on rules, procedures and period for notifying the change of terms and conditions of digital platform services (2566)

On 3 January 2024, the Electronic Transactions Commission’s (ETC) order on rules, procedures and period for notifying the change of terms and conditions of digital platform services (2566) entered into force. The order establishes guidelines for digital platform operators in Thailand to inform users and the Electronic Transactions Development Agency (ETDA) about changes to terms and conditions through clear and visible channels on the platform. If changes impact users' rights or are related to mandatory disclosures, operators must notify both users and the ETDA. Notification should occur at least 15 days prior to the changes taking effect, except in cases such as legal compliance, reducing burdens, or resolving service issues. Furthermore, the order allows users the right to terminate services if changes are significant. If technical or commercial adjustments are needed by users due to the changes, the operator must provide additional time beyond the usual notification period.
