On 4 August 2023, the Electronic Transactions Development Agency (ETDA) adopted the order on rules, procedures and conditions for notifying the cessation of operations of digital platform service businesses (no. 6/2566). The order establishes the requirements for digital platform operators in Thailand to formally notify the cessation of their business operations. It mandates that digital platform operators must submit a cessation notice at least 60 days prior to the intended cessation date, or 120 days for large platforms. Operators must provide detailed information, including the reason for cessation, date of cessation, communication channels to inform users, and measures to take care of users. Additional documentation, such as the operational plan for handling affected users, must also be submitted for larger platforms. Operators must inform users through agreed communication channels and submit evidence of these notifications to the ETDA. The notification outlines specific procedures for correcting or updating cessation information, and the ETDA will issue a formal receipt of notification only after verifying that all requirements are met and no further user issues remain. Once the receipt is issued, the business is officially considered terminated. The ETDA will then publish a public notice of the cessation to ensure transparency and public awareness. The order will enter into force on 21 August 2023.
