Implemented ETDA order on characteristics of digital platform services required to notify brief details (2566)

On 21 August 2023, the Electronic Transactions Development Agency’s (ETDA) order on characteristics of digital platform services required to notify brief details (2566) entered into force. The order establishes a framework for digital platform services operating in Thailand. It outlines the types of platforms that must report their details to the ETDA before commencing operations. According to the notification, digital platform services that are required to notify the Electronic Transactions Commission include those with annual revenue within Thailand not exceeding 1.8 million baht for natural persons or 50 million baht for juristic persons, as well as platforms with no more than 5,000 monthly domestic users. Furthermore, the order specifies that certain website or application services that offer goods or services from a single owner or affiliated company, and those that provide web board services or hyperlink/banner services, are also subject to the reporting requirement if they meet specific criteria. To comply with this regulation, operators must provide ETDA with basic information about the operator, such as name, identification number, address, and contact details, along with information about the digital platform service, including its name, type, and service channels. In addition, foreign-based operators must provide a point of contact in Thailand. Furthermore, the notification mandates that digital platform operators must submit annual reports containing details of their revenue, transaction value, and user statistics within sixty days of the end of the calendar or accounting year, depending on whether the operator is a natural person or a juristic person. The ETDA is responsible for reviewing the characteristics of digital platform services that are exempt from prior notification at least once a year to ensure they meet the defined criteria.
