Thailand: Implemented full-form notification requirement of Royal Decree on the Operation of Digital Platform Service Businesses

On 18 November 2023, the full-form notification requirement of the Royal Decree on the Operation of Digital Platform Service Businesses B.E. 2565 (2022) entered into force. In particular, companies with a gross income exceeding THB 50 million annually or more than 5,000 monthly active users in Thailand were required to submit a full-form notification providing detailed business information. The decree mandates both domestic and international digital platform services to notify the Electronic Transactions Development Agency (ETDA) of their operations and adhere to relevant obligations. A "digital platform service" is defined as an intermediary service that connects business users, consumers, or users for electronic transactions, whether paid or unpaid. Services where a single operator or its affiliate offers goods or services, acting as its representative, are not subject to the decree. Businesses are subject to 2 types of notification: full-form notification and short-form notification. Other platform providers, including e-service platforms with web boards, hyperlinks, or banners, must submit a short-form notification by 20 August 2024.
