Adopted Telecommunications Law (No. 24/2023/QH15) including unilateral conduct regulation

On 24 November 2023, the Telecommunications Law (No. 24/2023/QH15) was adopted. Article 17 of the legislation delineates the regulatory framework applicable to telecommunications businesses that exert a dominant influence within the market. The government establishes the criteria for identifying these markets and businesses, while the Minister of Information and Communications is responsible for issuing the relevant lists. Dominant businesses are required to comply with a number of additional obligations, including the provision of wholesale services, the implementation of cost accounting procedures, the avoidance of below-cost pricing, and the creation of model agreements for wholesale transactions.
