Description

Announced European Commission investigation into Apple concerning its interoperability obligations under the Digital Markets Act

On 19 September 2024, the European Commission announced the launch of an investigation, consisting of two specification proceedings, into Apple to help ensure that the company complies with its interoperability obligations under the Digital Markets Act (DMA). In particular, the DMA requires Apple to offer free and effective interoperability between its hardware and software features, such as iOS and iPadOS, and third-party developers. The first proceeding focuses on Apple's iOS connectivity features, which are significant for devices like smartwatches, headphones, and VR headsets, aiming to ensure interoperability in areas like notifications, device pairing, and connectivity. The second proceeding examines Apple's process for handling interoperability requests from developers and third parties, emphasising the need for transparency, timeliness, and fairness. The Commission will complete the proceedings within six months, during which it will provide Apple with its preliminary findings and recommended compliance measures.
