Announced Regulation on Data Protection Consent Management Services

On 4 September 2024, the Federal Ministry for Digital and Transport announced that it had approved a Regulation on Data Protection Consent Management Services and tabled it in Parliament for final approval. The Federal Council has already granted its approval. The Regulation would set out the requirements for data protection consent management services which allow users to manage their consent decisions as alternatives to recurring cookie banners. The Regulation also sets out the process by which such services would be recognised by the Federal Commissioner for Data Protection and Freedom of Information and the technical requirements for the incorporation of such services into data subjects' uses of internet information services.
