On 1 November 2021, the Virginia Consumer Data Protection Work Group of the Joint Commission on Technology and Science (JCOTS) published its final report containing findings regarding the Virginia Consumer Protection Act (VCDPA) before it is implemented in January 2023. Such a report is required by the VCDPA as the workgroup was created to optimize the VCDPA. The VCDPA passed on 2 March 2021. The final report outlines 17 points of emphasis that were identified during the Work Group meetings. Some of the points and recommendations raised are: - Creating educational initiatives to assist businesses in complying with VCDPA - Changing the provision of the “right to delete” to a “right to opt-out of sale” provision - Considering specific data privacy protection provisions for children - Providing authority to an agency to promulgate regulations, since the Attorney General doesn't have the authority to issue regulations under VCDPA
