Issued OAIC Statement on Clearview AI

On 21 August 2024, the Office of the Australian Information Commissioner (OAIC) issued a statement concerning the determination issued on 14 October 2021 on Clearview AI's conformity with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 which found that the company’s facial recognition search tools and biometric templates breached the Privacy Act by collecting, from publicly available online sources, sensitive information of individuals without consent and failing to adopt reasonable measures to comply with the APPs. Following media reporting in 2024 alleging that Clearview AI continued to collect images from individuals in Australia, the OAIC has stated that after considering the allegations, it is not satisfied that further action is warranted against Clearview AI.
