Announced Creation of New Hampshire Data Privacy Announced Creation of New Hampshire Data Privacy Unit

On 15 August 2024, the Attorney General announced the establishment of a new Data Privacy Unit within the Consumer Protection and Antitrust Bureau of the New Hampshire Attorney General's Office. The Unit is tasked with enforcing the New Hampshire Data Privacy Act (RSA 507-H), aiming to enhance accountability, transparency, and consumer choice in the handling and monetisation of personal data by companies. The Unit will develop guidelines to inform consumers and businesses about their rights and responsibilities under the Act. Specifically, the Act gives consumers the rights over their personal data, including confirmation, correction, deletion, and portability of their data, and the option to opt out of data processing for targeted advertising, sales, or profiling. The Act, effective from 1 January 2025, imposes penalties of up to USD 10' 000 per violation for non-compliance, with potential criminal penalties for intentional failures to comply.
