European Union: Announced appeal in lawsuit challenging designation as very large platform and disclosure of user identities in advertisement repository under the EU DSA (Aylo Freesites v European Commission)

Description

Announced appeal in lawsuit challenging designation as very large platform and disclosure of user identities in advertisement repository under the EU DSA (Aylo Freesites v European Commission)

On 26 July 2024, Aylo Freesites, the parent company of Pornhub, filed an appeal against the interim ruling issued by the General Court, challenging its designation as a very large platform and disclosure of user identities in the advertisement repository under the EU Digital Services Act (DSA). The Court concluded that Pornhub's claims were not supported by specific and detailed evidence, particularly regarding the extent and irreversibility of the alleged harm and determined that the EU's interest in enforcing transparency and regulatory oversight outweighed Aylo's concerns and dismissed the application for interim measures. Aylo is appealing the decision seeking urgent relief from the obligation under the DSA to disclose the real names of individuals advertising on its platform, including sex workers and performers. Aylo contends that making these names publicly available in the ad repository would compromise the safety of the individuals.
