European Union: Closed consultation on functioning of EU-US Data Privacy Framework

On 6 September 2024, the European Commission closes a public consultation on the functioning of the EU-US Data Privacy Framework. The Commission is required to issue a report on the adequacy decision adopted in July 2023 aimed at enhancing data protection and legal certainty for transatlantic data transfers. The report will assess new safeguards and mechanisms introduced, such as limits on US intelligence access to EU data and the establishment of an independent review court. The consultation seeks feedback on the operation of the EU-US Data Privacy Framework, focusing on whether all elements have been effectively implemented under US law and are functioning as intended and any other relevant aspects of the Framework's operation. The European Commission will issue the report in the third quarter of 2024.
