Closed consultation on NYAG Regulations enforcing the New York Child Data Protection Act

On 30 September 2024, the Attorney General of New York closes a public consultation on the regulations enforcing the Child Data Protection Act (CDPA). The CDPA applies to operators of websites, online services, online applications, mobile applications, and connected devices that process data linked to minors under 18 years old, setting out the permitted purposes for processing the personal information of minors, setting out the conditions for informed consent, and prohibiting the sale of minors' personal data. The consultation seeks input on issues including the definitions of personal data, monetary sale of personal data, permissible processing, informed consent and parental consent to inform the Attorney General's enforcement approach and the content of the planned regulations.
