On 16 July 2024, the proposal for incorporation of the MERCOSUR Electronic Commerce Agreement into Brazilian law was submitted to the Chamber of Deputies of Brazil. The Agreement covers businesses and entities involved in the production, distribution, marketing, sale, or delivery of goods and services through electronic means across the Southern Common Market (MERCOSUR). The Agreement facilitates cross-border data transfers and imposes several obligations, including the prohibition of customs duties on electronic transmissions, recognition of electronic signatures, adherence to MERCOSUR regulations on consumer protection, and requirements for data protection and privacy. The proposal highlights that incorporation of the provisions of the Agreement will fill the gap in Brazil's digital economy regulations, complementing existing agreements on digital signatures and consumer protection and support Brazil's priority for MERCOSUR's modernisation, focusing on trade integration and economic competitiveness.
