On 8 July 2024, the Bill amending Law No. 13.709 on the General Personal Data Protection Law to determine criteria for the use of personal data in artificial intelligence systems was introduced in the Chamber of Deputies of Brazil. The Bill sets criteria for using personal data in training and enhancing artificial intelligence (AI) systems. The Bill targets entities involved in AI development and imposes obligations such as requiring prior and explicit consent from data subjects specifically for AI training and mandates consent renewal with each significant AI system update. The Bill also proposes the right to easily revoke consent and prohibits using data from individuals under 16 years old for AI training.
