Issued ruling in MCC investigation into alleged anti-competitive behaviour at ASWARA concerning IT services (No. 700‒1/1/38/2016)

On 27 June 2022, the Malaysian Competition Commission (MCC) issued a ruling in their investigation into anti-competitive behaviour at the National Academy of Arts, Culture, and Heritage of Malaysia (ASWARA) concerning IT services (No. 700‒1/1/38/2016). The MCC found eight enterprises guilty of infringing Section 4(1) in conjunction with sections 4(2)(d) and 4(3) of the Competition Act 2010 (Act 712). The investigation revealed a series of anti-competitive bid-rigging agreements and/or concerted practices related to procurement projects at ASWARA. These infringements led to the imposition of total penalties amounting to MYR 1’548’192.35 (ca. USD 330’000) against the involved parties.
