On 10 June 2024, Bill 3003-D-2024, establishing a legal framework for the regulation of the responsible use of Artificial Intelligence (AI), was introduced in the Chamber of Deputies of Argentina. The Bill applies to individuals and entities involved in providing, deploying, importing, distributing, manufacturing, and using AI systems within Argentina. The Bill categorises AI systems based on the risks they may pose into unacceptable, high, medium, and low, prohibiting the deployment of systems posing unacceptable risks. Unacceptable risks and prohibited practices include any actions that threaten individual rights, such as cognitive or behavioural manipulation that distorts a person's behaviour, hinders informed decision-making, or coerces decisions that may cause harm. Social scoring systems or classifications based on behaviour, status, or characteristics over time are also prohibited if they lead to harm, unfair treatment, or denial of rights solely based on these scores. Additionally, real-time biometric identification systems are generally prohibited but may be temporarily authorised by judicial order for specific situations such as terrorist threats, victim identification, missing person searches, or serious crime prosecutions, provided an AI impact assessment is conducted, and the National Directorate of Personal Data Protection is notified.
