PCPD Guidance for Companies Affected by EU SCC Data Transfer Standard Issued

On 14 September 2021, the Hong Kong Office of the Privacy Commissioner for Personal Data (PCPD) has issued a set of FAQs to provide advice to entities affected by the European Union's new Standard Contractual Clauses (SCCs) for data transfers outside the EU, which were adopted by the European Commission on 27 June 2021. The FAQs provide information on which Hong Kong-based entities may be affected by the SCCs, and what the scope of the obligations under the SCCs are. Notably, even companies that don't fall under the GDPR, but import EU personal data, may be obliged to implement new SCCs.
