Implemented SPF Code of Practice for E-Commerce Services including content moderation regulation

On 27 December 2024, the Singapore Police Force (SPF)’s Code of Practice for E-Commerce Services under the Online Criminal Harms Act 2023, enters into force. The code requires all designated e-commerce service providers to implement measures to counter and prevent the use of their platforms for scams and malicious cyber activities. The code mandates that designated providers must proactively detect and promptly address suspected scams and malicious activities, allow end-users to report such activities through accessible mechanisms, and implement a fast-track channel for reports from law enforcement agencies. Providers must retain relevant data for investigations, maintain records as requested by law enforcement, and facilitate requests for information through expedited channels. Furthermore, the providers are required to ensure verification measures to prevent the creation of fraudulent accounts, conduct additional checks for suspicious activities, and enforce strong login verification features. They must offer the option for account holders to designate their accounts as “verified” and subject users who advertise or sell goods to verification against government records. Payment protection mechanisms must also be provided as an option for users. Finally, designated providers must submit an annual report detailing their efforts to counter scams and malicious activities, including descriptions of policies, challenges faced, and metrics on the effectiveness of their actions. The designated e-commerce services include Carousell, Facebook Marketplace, Facebook Advertisements, and Facebook Business Pages.
