Announced KFST investigation into Temu over alleged violations of Digital Service Act

On 7 June 2024, the Danish Competition and Consumer Authority (KFST) announced an investigation into Temu over alleged violations of the EU's Digital Services Act (DSA). In particular, the KFST announced that it had forwarded a case concerning the online platform Temu to the European Commission and the Irish DSA supervisory authority after initial investigations suggested potential violations of the DSA obligations. The investigation was opened following complaints from the Danish Consumer Council and other European consumer organisations, citing concerns that Temu may not be complying with EU regulations that mandate digital platforms to sell only legal and safe products in the EU. Temu, with over 45 million monthly users in the EU, has recently been classified as a very large online platform under the DSA, based on which Temu is subject to additional obligations, including the management of systemic risks such as the spread of illegal content.
