Issued High-Level Group public statement on Artificial Intelligence for the Digital Markets Act

On 22 May 2024, the High-Level Group (HLG) for the Digital Markets Act (DMA) issued a public statement on Artificial Intelligence (AI). The HLG notes that AI also affects digital market fairness under the DMA, specifying that gatekeepers must adhere to DMA obligations when integrating AI, with compliance assessments considering AI's impact. The HLG emphasises the need for appropriate regulatory frameworks and coordinated enforcement and states that continued cross-regulatory exchanges are necessary for developing a common understanding and coherent approach to AI-related challenges. Finally, the HLG states that it will monitor policy developments and explore the interplay between the DMA and other regulations, share enforcement experiences and regulatory expertise related to DMA and AI and develop methods for effective cooperation, ensuring consistent regulatory approaches across the DMA and other legal instruments.
